This Acceptable Use Policy ("AUP") outlines the rules and guidelines for using Banana Gene's AI-powered image generation and editing services. By using our platform, you agree to comply with this policy. This policy is designed to ensure that our platform is used responsibly, legally, and in a manner consistent with the requirements of our payment processors and applicable law.

2. Permitted Use

You may use Banana Gene to generate and edit images for lawful, creative, and commercial purposes, provided you comply with all applicable laws and this policy. All images you create using our platform may be used for commercial purposes, including marketing, advertising, product design, and any other business applications. You retain full rights to the content you generate.

3. Prohibited Content

You agree NOT to generate, upload, or create any content that:

  • Depicts or promotes sexual content, pornography, or adult material of any kind
  • Contains nudity, erotic, or sexually suggestive imagery
  • Promotes, depicts, or incites violence, terrorism, or physical harm to any person or group
  • Contains hate speech, harassment, discrimination, or extremist content based on race, religion, gender, sexual orientation, disability, or national origin
  • Infringes upon or enables the infringement of any copyright, trademark, or intellectual property rights of a third party
  • Creates or promotes Deepfakes, face swaps, or any synthetic media depicting real individuals without their explicit written consent
  • Generates human-like faces in realistic, stylized, or animated forms for the purpose of impersonation, fraud, or non-consensual use
  • Misrepresents a real person's likeness without their explicit written consent
  • Generates realistic human-like images intended to impersonate a specific real individual without their explicit written authorization, including but not limited to face swaps and deepfakes
  • Creates misleading, fraudulent, or deceptive content intended to defame, impersonate, or cause harm
  • Generates illegal goods, services, or regulated products (e.g., weapons, drugs, counterfeit goods)
  • Violates any law, regulation, or governmental requirement in your jurisdiction
  • Is related to gambling, pyramid schemes, or other prohibited financial activities
  • Is associated with pseudo-science, medical misinformation, or unverified health claims presented as fact
  • Exploits, targets, or endangers minors in any way, including the generation of Child Sexual Abuse Material (CSAM)
  • Constitutes non-consensual intimate imagery (NCII) or any content that violates a person's privacy or dignity

4. Content Safety Policy

Banana Gene is committed to maintaining a safe, legal, and professional platform. We employ multiple layers of technical and operational measures to prevent the generation, upload, or distribution of prohibited content. Our content safety infrastructure includes the following components:

4.1 Automated Detection Systems

  • Prompt Keyword Filtering: All text prompts are scanned against a continuously updated blocklist of prohibited keywords and phrases before processing. Prompts containing terms associated with explicit content, non-consensual imagery, or other prohibited categories are automatically rejected prior to image generation.
  • AI-Powered Image Scanning: Every generated image is analyzed in real-time by our AI-based content detection system. Images flagged as explicit, pornographic, sexually suggestive, or otherwise violating this policy are automatically blocked and will not be delivered to the user.
  • Multi-Stage Review Pipeline: Content passes through multiple detection checkpoints — at prompt submission, during generation, and upon output delivery — to ensure comprehensive coverage and minimize the risk of prohibited content reaching users.
  • Input Image Screening: All user-uploaded images are scanned for prohibited content prior to processing. Images containing explicit, illegal, or otherwise prohibited material are rejected before they can be used as generation inputs.

4.2 Human Review and Reporting

  • Manual Review: Content that falls near automated detection thresholds undergoes additional human review to minimize false positives while maintaining strict safety standards. Our review team is trained to identify and act on policy violations.

4.3 Enforcement Actions

Violations of this policy are handled according to the following tiered enforcement framework:

  • First Violation: The offending content is removed, any associated generation credits are forfeited, and the user receives a formal written warning detailing the violation.
  • Repeated Violations: Account suspension for a period determined by the severity and frequency of violations. Suspended users will be notified of the suspension duration and the conditions required for reinstatement.
  • Severe Violations: Immediate and permanent account termination without refund. Where required by applicable law, the violation and associated user data will be referred to the appropriate authorities, including but not limited to law enforcement agencies and the National Center for Missing & Exploited Children (NCMEC) for CSAM-related violations.

4.4 Continuous Improvement

We regularly update our detection algorithms, expand our keyword blocklists, and refine our AI scanning models to stay ahead of evolving methods used to circumvent content safety measures. Our commitment to platform safety is ongoing and we invest continuously in improving our moderation capabilities. We also monitor changes in applicable laws and payment processor requirements to ensure our policies remain current and compliant.

5. Content Moderation

Banana Gene employs automated content moderation systems to detect and prevent prohibited content. We reserve the right to:

  • Block, filter, or refuse content that violates this policy
  • Suspend or terminate accounts that repeatedly violate this policy
  • Report illegal content to relevant authorities
  • Review content prior to publication or in real time to ensure compliance with payment provider requirements

While we make every effort to enforce this policy, Banana Gene cannot guarantee that all prohibited content will be detected or blocked. Users are solely responsible for ensuring their use of the platform complies with this policy and all applicable laws.

6. User Responsibilities

By using Banana Gene, you agree that you are solely responsible for:

  • The content you generate using our platform
  • Ensuring you have the necessary rights to any input images you upload
  • Obtaining explicit written consent from any identifiable individuals depicted in generated content
  • Ensuring your use of generated images complies with applicable laws in your jurisdiction
  • Maintaining the security of your account and credentials
  • All activities that occur under your account
  • Ensuring that any generated content involving human subjects is used only in ways that respect the dignity, privacy, and rights of those individuals

7. Intellectual Property

You retain full ownership and commercial rights to the images you generate using Banana Gene. However, you are solely responsible for ensuring that your generated content does not infringe upon the intellectual property rights of any third party. Banana Gene and its licensors retain all rights to the underlying technology, software, and platform infrastructure.

8. Violations

Violations of this Acceptable Use Policy may result in:

  • Immediate suspension or termination of your account
  • Forfeiture of any credits or subscription fees
  • Removal of prohibited content from our platform
  • Civil or criminal liability for violations of law
  • Indemnification obligations as outlined in our Terms of Service
